Terms & Conditions

1. Agreement

1.1
These Terms and Conditions (“Terms”) govern the provision of services by Omne Hub Sdn. Bhd. (“the Company”) to the customer (“you”).
1.2
It is your responsibility to review these Terms thoroughly and ensure all order information is accurate and complete before submission.
1.3
Our obligation to provide services commences only upon acceptance of your order, which will be confirmed via electronic communication.
1.4
A unique reference number will be assigned upon order confirmation; this must be referenced in all subsequent communications.

2. Order Submission and Confirmation

2.1
Orders must be submitted with all required information and accompanied by valid payment.
2.2
Confirmation of order acceptance will be provided via email and displayed with a reference number.
2.3
The Company may perform services directly or engage third-party subcontractors as necessary.
2.4
All orders must adhere strictly to the Company’s guidelines; failure to comply may result in non-fulfilment of services.
2.5
Customers are responsible for:

a) Printing and attaching the provided shipping label; b) Ensuring the parcel is securely packaged and addressed to a valid Malaysian destination; c) Complying with prescribed parcel weight and dimension limitations; d) Delivering the parcel to the designated drop-off location; e) Retaining proof of parcel submission.

3. Service Delivery

3.1
Services will be carried out with reasonable skill and due care.
3.2
Estimated delivery times are indicative and are not guaranteed.
3.3
The Company reserves the right to subcontract any portion of the service.
3.4
The Company maintains sole discretion over routing, handling, and operational procedures.
3.5
Recipients may be required to present valid identification prior to parcel collection.
3.6
For return services, one delivery attempt will be made; uncollected parcels will be redirected to a collection centre. If uncollected after seven (7) days, parcels may be returned at your expense or disposed of after one (1) month.
3.7
Receipt of parcels by the consignee confirms acceptance of parcel condition; the Company disclaims liability for any subsequent damage.

4. Fees and Payment

4.1
Service fees are payable as indicated at the time of order placement.
4.2
Fees are determined by parcel size, weight, and service type.
4.3
Additional charges may apply for parcels exceeding specified limits; the Company may withhold parcels until all fees are settled.
4.4
The Company reserves the right to adjust fees at its discretion with notice provided on its official channels.

5. Parcel Specifications

5.1
Parcels must be packaged, labelled, and meet size and weight requirements as stipulated by the Company and its partners.
5.2
Non-compliant parcels may be refused acceptance or returned.
5.3
Prohibited contents include hazardous materials, human or animal remains, confidential documents, currency, valuables, perishables, and illegal items.
5.4
Parcels found to contain prohibited items will be rejected, returned, or destroyed, with the sender held fully liable for all consequences.

6. Liability and Claims

6.1
Liability for loss or damage due to the Company’s negligence is limited to RM200.
6.2
All claims must be submitted in writing within fourteen (14) days of delivery or expected delivery date.
6.3
The Company shall not be liable for delays caused by factors beyond its control.
6.4
Liability does not extend to damage or loss arising from inadequate packaging, incorrect labelling, or failure to provide valid delivery information.
6.5
The Company disclaims any liability for indirect, consequential, or financial losses.

7. Customer Representations

7.1
By submitting parcels, you confirm ownership or authorised authority to dispatch the parcel.
7.2
The Company reserves the right to refuse service if such authority cannot be established.

8. Force Majeure

8.1
The Company is not liable for delays or failures resulting from events outside its reasonable control, including but not limited to natural disasters, labour disputes, or infrastructure failures.
8.2
Customers will be notified where possible, and obligations may be suspended accordingly.
8.3
Parcels may be returned at the customer’s expense if services are cancelled due to such events.

9. Refund Policy

9.1
All fees are non-refundable except as expressly stated otherwise.

10. Promotional Offers

10.1
Promotional offers apply solely to orders placed through the Company’s official channels, unless otherwise specified.
10.2
Offers are non-transferable, cannot be combined, and are not redeemable for cash.
10.3
Unless explicitly stated, promotions are limited to one use per customer.
10.4
The Company reserves the right to modify or withdraw promotions at any time without prior notice.

11. Amendments

11.1
Any amendments to these Terms must be documented in writing.
11.2
The Company may update these Terms with at least seven (7) days’ notice published on its website.

12. Governing Law

12.1
These Terms are governed by the laws of Malaysia and subject to the exclusive jurisdiction of Malaysian courts.

13. Waiver

13.1
Failure by the Company to enforce any provision shall not be deemed a waiver of rights.

14. Severability

14.1
Should any provision be found invalid or unenforceable, the remainder shall remain in full effect.

15. Privacy

15.1
Use of the Company’s services constitutes acceptance of the Privacy Policy and agreement to these Terms.
